Mediation is one of the "better ways," proven to be so through years of observation, study, and practice. While court trials are sometime unavoidable, the cost and uncertainty of the process often makes it the worst dispute resolution process for business. Business people would hestitate to put their business decisions in the hands of persons with no knowledge of, or experience in, their industry. Yet this is exactly what the parties ask the jury to do in business cases.
Mediation allows business people to retain control of their own decision making processes. Mediation also has the virtue of being significantly cheaper than litigation in almost all cases, quite a bit faster, and is perhaps the only dispute resolution process to present the potential of certainty of result.
